Lucknow: The Allahabad high court ordered a man, who was accused of abetment of suicide of his wife and had claimed that his wife was depressed as she was 'infertile', to undergo a 'virility test'.

A single bench comprising Justice Shekhar Kumar Yadav passed the order recently on a bail petition moved by the man, identified as Moni alias Monu, who was arrested after his wife died by suicide and was accused of abetment of suicide.

In his bail application, Moni, a resident of Garh Mukteshwar area in Uttar Pradesh’s Hapur district had claimed that his wife had slipped into depression as she was not able to bear children and had killed herself.

Moni, who was accused of instigating his wife to die by suicide, was charged under section 306 of the IPC (abetment of suicide) which provided for a punishment up to 10 years and also fine. Moni claimed innocence.

Moni, who was also accused of harassing his wife to bring more dowry, is currently lodged in the Hapur district jail.

The court, while hearing the bail application, said that it could not be said that only the wife was always responsible for not bearing children. The husband might also be responsible for the same, it said.

The court ordered the accused to undergo a ‘virility test’ and directed that the report of the test be produced before the court within 10 days. It posted the matter for further hearing on November 12.
